1. Acceptance of Terms

By accessing or using Synergy Hub ("the Service"), operated by Hiraya Digital ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Synergy Hub is a marketing automation and business management platform that provides:

  • Social media management and automation
  • WhatsApp, Instagram, and Facebook messaging integration
  • Customer relationship management (CRM)
  • Marketing flow automation
  • Analytics and reporting
  • Team and HR management tools
  • E-commerce integrations (WooCommerce, etc.)

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use the Service
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or violate anti-spam laws
  • Harass, abuse, or harm others
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or engage in hacking activities
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service for illegal activities

5. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook, Instagram, WhatsApp), Google, and others. By using these integrations:

  • You agree to comply with their respective terms of service
  • You authorize us to access and process data from these platforms on your behalf
  • You understand we are not responsible for third-party service availability or changes
  • You are responsible for maintaining valid API credentials and permissions

6. Messaging Compliance

When using messaging features (WhatsApp, SMS, etc.), you must:

  • Obtain proper consent before sending messages to recipients
  • Comply with all applicable messaging laws (TCPA, GDPR, etc.)
  • Honor opt-out requests promptly
  • Not send messages outside of permitted hours
  • Maintain accurate records of consent

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by Hiraya Digital and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload or create through the Service.

By uploading content, you grant us a non-exclusive license to use, store, and process that content to provide the Service.

8. Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to change pricing with 30 days notice
  • Failure to pay may result in suspension or termination of your account

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for:

  • Complying with data protection laws applicable to your business
  • Obtaining necessary consents from your customers
  • Maintaining appropriate data security practices

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Make updates or changes to improve the Service
  • Suspend service for security or legal reasons

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIRAYA DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Hiraya Digital from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of third parties.

13. Termination

  • You may terminate your account at any time
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, you may request export of your data within 30 days
  • We reserve the right to delete data after account termination

14. Modifications to Terms

We may modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
